According to the Complaint, as early as 2000, the defendants discovered that the Zylon material used in the vests was degrading after exposure to heat, humidity, light, wear, care and in-service flex, resulting in the vests losing their protective qualities. The Complaint alleges that the defendants failed to take prompt and adequate steps to notify purchasers of the defects and continued to sell the vests with knowledge that their representations and warranties concerning the performance characteristics were false. The Complaint further alleges that the defective vests are unsuitable for the intended uses and thus, purchasers are entitled to a refund of the purchase price or replacement, at no cost, with non-Zylon vests that meet or exceed the warranted performance specifications for the Ultima and Ultimax vests, and that are proven, tested and certified by the National Institute of Justice.
