Alaska DOC confirms inadvertant recording of attorney-client calls

DOC is not sure how or why the calls were being monitored

ANCHORAGE, Alaska — DOC officials say they are investigating the inadvertant recording of attorney-client calls.

A public defense attorney mentioned to a judge at a hearing last week that he had been cautioned by his agency about discussing confidential matters with clients in custody at state correctional facilities, according to the Alaska Public.

The agency had learned that the state’s DOC was either monitoring or recording phone calls between inmates and their attorneys, a practice that defies the attorney-client privelege.

The Alaska DOC’s own policy clearly states that “calls between a prisoner and an attorney may not be monitored except when authorized by court order.”

Once the department realized the calls were being recorded, steps were taken to correct the problem. Still, there are no answers as to how or why the calls were being monitored.
