WASHINGTON — An inmate accused in the death of Correctional Officer Jose Rivera is seeking a life sentence in exchange for pleading guilty.

If accepted, the deal would spare inmate James Ninete Leon Guerrero from a possible death sentence, according to the Sacramento Bee.

It would, however, leave the first-degree murder case against his fellow defendant, allegedly seen wielding a shank in the videotaped murder of CO Rivera.

The final decision will be made at the Justice Department’s highest levels, as the government’s initial decision to seek the death penalty required Attorney General Eric Holder’s written authorization.
