PIERRE, S.D. — The Supreme Court has declined to hear Rodney Berget’s request to have his 2012 conviction and capital sentence for the murder of a correctional officer overturned.

“I believe due process has been satisfied and that the interest of justice has been served,” Attorney General Marty Jackley said, according to the Argus Leader.

Berget is to be executed the week of May 3 for the 2011 killing of Correctional Officer Ronald ‘RJ’ Johnson during a failed escape attempt.
