HUNTSVILLE, Texas — The U.S. Supreme Court has rejected a last-day appeal from Texas death row inmate Donald Newbury.
He’s set to die for the slaying of a suburban Dallas police officer while he and six other escaped prisoners who became known as the “Texas 7" were on the run.
The 52-year-old Newbury is scheduled for lethal injection Wednesday evening. He’d be the third member of the fugitive gang put to death for the fatal shooting of 29-year-old Irving police officer Aubrey Hawkins, who interrupted the gang’s Christmas Eve 2000 robbery of a sporting goods store.
The seven prisoners carried out the biggest prison break in Texas history 11 days before Hawkins’ killing. They were caught weeks later in Colorado.
