SAN DIEGO — A death row inmate has won his public records fight against the San Diego district attorney.
According to court records, LaTwon Weaver wants documents for his own investigation into what role race may play in how death row cases are decided.
Weaver was convicted in the fatal shooting of a jewelry store owner in the city of Vista in 1992.
UT San Diego reports that the district attorney’s office denied his request for documents related to charges against homicide suspects in San Diego County between 1977 and 1993.
Prosecutors argued the documents are not releasable because they are part of investigatory files.
In an opinion published last week, state appeals court judges ruled that charging documents filed publicly in court are not investigatory, and should be released.
