GERING, Neb. — The juvenile inmate who was convicted of the murder of Corrections Officer Amanda Baker is seeking a new trial.
The Journal Star reports that Dylan Cardeilhac, who was 15 at the time of the murder, is arguing for a new trial Friday.
Jim Mowbray of the Neb. Commission on Public Advocacy will argue that Cardeilhac didn’t get a fair trial due to one juror acting out the strangulation for another.
The second juror said she had intended to find the teen guilty of a lesser charge of involuntary manslaughter, but changed her mind and deemed him guilty of second-degree murder after the re-enactment.
Mowbray claims the re-enactment “did not accurately reflect the evidence at trial” and prejudiced his client.
Originally, Cardeilhac’s sentencing was to take place Friday but has instead been moved to Feb. 19 to give the court more time to rule on the motion for a new trial.
