NEW BRUNSWICK — The Middlesex County jail has to be brought into the electronic age even if it’s “kicking and screaming.”
That was the message Superior Court Judge Bradley Ferencz gave the county today after hearing that the jail does not have the equipment it needs for inmates at the North Brunswick facility to view their evidence contained on compact discs, DVD’s and flash drives.
“E-discovery is here,” Ferencz told Benjamin Leibowitz, senior deputy county counsel. “You need to address the issue, kicking or screaming or not. You have to deal with it.”
Ferencz was listening to arguments made by attorneys for six pre-trial inmates, the Middlesex County Office of the Public Defender, and other attorneys, that said the jail violates the inmates’ constitutional rights to view all of the evidence against them. Five additional inmates and their attorneys will come in Friday to acknowledge their participation in the motion. All of the inmates are represented by the public defender’s office.
