BROOKLYN, NY — The retired correctional officer who shot and killed a man at a Brooklyn subway station will not faces charges.
ABC News reports that an autopsy showed Gilbert Drogheo died from a bullet to the heart, which police say came from a gun fired by William Groomes during a dispute at a Borough Hall station.
Brooklyn District Attorney Ken Thompson said that after a “full and fair” investigation, he had decided that criminal charges were not warranted.
“While the death of this young man was indeed tragic, we cannot prove any charge of homicide beyond a reasonable doubt,” he said in a released statement.
Another man was arrested in connection with the subway shooting; Joscelyn Evering, 28, is charged with assault and menacing stemming from the encounter on the train involving the retired officer.
Groomes maintains that he acted in self- defense after getting into an argument when one of the men said something offensive to him. The argument quickly spilled out onto the mezzanine level of the station, ending with shots fired.
