Officer cleared in Pendleton prison yard shooting

Grand jury found the officer was justified in the use of deadly force

UMATILLA COUNTY — The investigation of a corrections officer who shot and killed an inmate this summer in Pendleton has been found to have been by the book, according to the district attorney.

The Union-Bulletin reports that a grand jury found the officer was justified in the use of deadly force.

The officer’s first name has not been released.

He was in the gun tower the morning of Aug. 29 when he shot inmate Jayson Matthew Withers to stop him and inmate Cameron Hayes from attacking another inmate, Eric Dean Sexton.

Investigators interviewed 189 inmates who were in the yard at the time of the shooting. All staff members who were working at the time also submitted reports, whether they were involved in or even witnessed the shooting.

Hayes was indicted for third-degree assault.
