Pa. county seeks dismissal of CO suit

Nancy Carroll claims her due process rights were violated, and that she was also a victim of gender discrimination

LACKAWANNA COUNTY, Pa. — An attorney for Lackawanna County filed a second motion to dismiss a federal lawsuit filed by a prison employee who claims she was wrongly demoted following the near fatal beating of an inmate.

Nancy Carroll filed suit in 2012, alleging her due process rights were violated when she was demoted from corporal to correctional officer in December 2010 after inmate Nicholas Pinto was severely beaten by inmate Michael Simonson. The suit also claimed she was the victim of gender discrimination.

Mr. Pinto, who was held in the county prison pending sentencing on federal child pornography charges, suffered brain damage after he was attacked by Mr. Simonson. Ms. Carroll was among the prison employees on duty at the time of the attack. Her lawsuit alleged she was subjected to disciplinary action, even though she had no involvement in the assault.
