CHARLESTON, W.Va. — A Tennessee man accused of taking a police officer’s gun and using it to shoot another officer at Charleston Area Medical Center’s General Hospital earlier this year pleaded not guilty to the charges against him Monday.
Kanawha Circuit Judge Charles King scheduled the trial for Bryan Lee Ogle II, 31, for July 23.
Ogle wore a red jumpsuit during Monday’s arraignment with writing on the back that indicated he was a high-risk inmate, and he only talked to answer King’s questions during the arraignment.
Kanawha Assistant Prosecuting Attorney Maryclaire Akers said Ogle has suffered a drug overdose since he’s been incarcerated at South Central Regional Jail. Akers said the overdose required Ogle to be treated at a local hospital.
A Kanawha County grand jury indicted Ogle last month on charges of escape, malicious wounding, assault during the commission of a felony, attempt to disarm a law enforcement officer, attempted murder, wanton endangerment, and persons prohibited from possessing a firearm.
A federal grand jury also indicted Ogle on one count of being a felon in possession of a firearm last month as well.
Ogle is accused of scuffling with and disarming a police officer and using the gun to shoot another officer on Feb. 10 at CAMC General. Ogle was recovering from injuries he suffered in a car wreck while he allegedly fled from Montgomery police officers on Feb. 8.
Following the car wreck, Ogle also fought and attempted to disarm a police officer, but he did not obtain the officer’s gun, according to the criminal complaint filed in Kanawha County Magistrate Court.
At the time of the car chase, Ogle’s driver’s license was suspended for convictions for driving under the influence. He was wanted for felony charges in Tennessee, according to the criminal complaint.
