Judge puts prisoner’s sex-change order on hold

BOSTON — With an appeal looming, a federal judge yesterday put on hold his earlier order forcing the Department of Corrections to grant a sex-change operation to convicted wife-killer Michelle Kosilek — noting the surgery is “irrevocable” and taxpayers would be denied “relief” should the state prevail in a higher court.

But U.S. District Court Chief Judge Mark L. Wolf issued a strong warning to DOC brass, saying they need to “make a good faith effort to provide sexual reassignment surgery in a timely manner” to the prisoner otherwise “the issues of criminal and civil contempt will arise.”

Wolf, who issued a stay on the surgery pending the appeal, is requiring the DOC to provide Kosilek and his legal team monthly progress reports, which the judge ordered sealed to prevent “harassment” of the doctors in the case.
