Bill to criminalize conduct against corrections officers approved

Spitting, placing other bodily fluids or contents of toilet bowls on officers would be a felony

ALBANY – The State Senate has passed legislation sponsored by Senator John Bonacic (R- Mt. Hope) that would criminalize certain conduct against corrections officers and other employees of state prisons.

The legislation, which has passed in the senate in previous years but has not been voted on in the Assembly, would make it a felony if an inmate intentionally spits on a corrections officer or otherwise places saliva, urine, feces or other contents of a toilet bowl on corrections officers. Under current law, a felony charge against an inmate may only be filed if those human materials are thrown, tossed or expelled onto the officer.

“This conduct is disgusting; it subjects the corrections officer to testing for various diseases, and makes our prisons less secure,” Bonacic said. “There should be serious consequences for such activity.”
