Charges filed in assault on SD corrections officer

Carlos Green is charged with one count of aggravated assault against a department of corrections employee

PIERRE, S.D. — South Dakota’s Attorney General says charges are being filed against the men accused of assaulting a corrections officer at the State Penitentiary in Sioux Falls on April 20.

Attorney General Marty Jackley announced Thursday that a Complaint has been filed charging inmate Carlos Rapheal Green, 28, Sioux Falls, with one count of aggravated assault against a department of corrections employee, class 2 felony, maximum sentence of twenty-five years imprisonment and/or $50,000 fine.

Inmate Garrett Austin Dumarce, 24, Sioux Falls, is also charged with one count of aiding, abetting or advising aggravated assault against a department of corrections employee, class 2 felony, maximum sentence of twenty-five years imprisonment and/or $50,000 fine. In conjunction with the Habitual Offender filing, Green faces up to life imprisonment and Dumarce faces up to fifty years imprisonment.
