Family of slain CO file notice of potential lawsuit against city and officials

Notice alleges that emergency personnel did not respond quickly enough to the shooting

TRENTON — The family of Mercer County Correction Officer Carl Batie, who was shot and killed while off-duty in November, has notified the city of Trenton, Mercer County and New Jersey officials that they may file a lawsuit against them in the coming months.

The notice — which was sent to the three on Jan. 29 — alleges that emergency personnel did not respond quickly enough to the shooting, in which Batie was struck in the head.

“Following the shooting, assistance from emergency personnel including but not limited to police and emergency medical technicians, was prolonged which ultimately contributed to the demise of Carl Batie,” according to the notices.

Batie, who was a five-year veteran of the county corrections department, was attending a party at the Baldassari Regency on Nov. 11 to celebrate President Obama’s reelection.
