Prosecutor: “He’s not HIV-positive, but he has hepatitis, so it’s considered a fifth-degree felony”

MARIETTA, Ohio — A man arrested for receiving stolen property will face new charges after he spat on a corrections officer at the Washington County Jail.

Larry Dean Loy, according to the Marietta Times, was sentenced on a fifth-degree felony count of harassment of a corrections officer with bodily fluids and a first-degree misdemeanor count of receiving stolen property.

“He’s not HIV-positive, but he has hepatitis, so it’s considered a fifth-degree felony,” said Washington County Prosecutor Jim Schneider.

Loy was originally arrested for the burglary of the Lewis Grimes home, which included an inoperable weapon, several rolls of quarters and some jewelry.

He was also charged with the fourth-degree felony count of possessing weapons under a disability, as a prior criminal violation prevented him from having a firearm. That charge was dropped as part of a plea deal.

Loy will also serve three years under parole supervision upon his release.
