Ill. DOC wants cut of convicted murderer’s settlement

DOC is seeking all but $25,000 of the total amount awarded to cover the cost of the inmate’s incarceration

CHICAGO, Ill. — The Illinois Department of Corrections is hoping to get a cut of a convicted murderer’s lawsuit settlement.

The Chicagoist reports that James Dergoski, one of two men convicted in the 1993 Palatine Brown’s Chicken murders, was awarded $451,000 after a corrections officer struck him and fractured some of his facial bones.

A judge later reduced the punitive judgment to $125,000, and the DOC is seeking all but $15,000 of the total amount awarded to cover the cost of Dergoski’s incarceration.

They are asking for $100,000 from that judgment.

The families of the victims may also seek part of the settlement.
