TULSA, Okla. — Cherokee County officials are contesting a judge’s ruling that jail video recordings that are the subject of an excessive-force civil rights lawsuit were improperly destroyed.

The Tulsa World reports that attorneys for the Cherokee County Governmental Building Authority have asked U.S. District Judge James Payne to reconsider his August 31st ruling to impose sanctions for the deleted video recordings, or at least allow the county time to appeal.

Records from U.S. District Court in Muskogee show Payne found that the authority overseeing the Cherokee County Detention Center and one of its employees were responsible for the destruction of video recordings made during the booking of Daniel Bosh.

Bosh claimed employees of the Tahlequah jail beat him in May 2011. No charges were filed against any of the jail employees.
