ATMORE, Ala. — An Atmore prison inmate has filed a civil complaint for medical malpractice after he claims a doctor cut off too many of his toes.
Deamfus Kimble, who is imprisoned at the Fountain Correctional Facility in Atmore, filed his complaint July 30 in Escambia County’s circuit court, Fox 10 reports.
According to court documents, Kimble says he was intentionally housed in a “bug and spider infested area” in June of 2023.
While staying in that dorm, Kimble says he was bitten by “poisonous spider.”
He was later given antibiotics by the prison healthcare provider, court records show.
He claims the infection from his spider bite spread after he was “recklessly disregarded” by medical personnel at the prison.
Once he visited a doctor outside the facility, Kimble was immediately taken back for surgery, court records show.
Before surgery, Kimble said that the doctor gave him the option to remove all his toes on the infected foot, but he agreed to have just his big toe removed, WALA reports.
When he woke up after surgery and saw all his toes on his right foot were gone, he screamed “why did you do this to me, I didn’t consent to you removing all my toes.”
Kimble wrote in the complaint WALA obtained that he can’t do certain tasks without pain and has trouble balancing and walking.
He’s suing the doctor and another doctor who works at Fountain Correctional Facility for $2 million in damages, the outlet reports.
Efforts to reach the Alabama Department of Corrections for comment were not immediately successful.
Kimble is serving five years for multiple offenses committed in Jefferson County including robbery and theft, according to court documents.
