N.M. officer resigns after admitting to sex with inmate

ALBUQUERQUE, N.M. — A sergeant at the Bernalillo County jail has resigned amid allegations that he had sex with an inmate, officials said Monday.

Sgt. Eric Asbury, 32, was arrested Sept. 28 on charges of criminal sexual contact and criminal sexual penetration, according to records.

Asbury bonded out of jail last week.

Jail officials began an investigation Sept. 23 when an orderly found a condom in a trash can in Asbury’s office. The orderly alerted another sergeant, who contacted the sheriff’s department.

The inmate, who had been in Asbury’s office for more than an hour that day, told a detective she and Asbury had exchanged letters about their mutual attraction toward each other, court records state.

The woman eventually asked Asbury if she could use his phone, according to court records.

Asbury had a guard place the woman in a holding cell, then later took her to his office where they had sex, the complaint said.

The woman said she had consensual sex with Asbury. He also admitted to the liaison, the complaint said. It is illegal for police and correctional officers to have sex with people in their custody.
