SANTA ANA, Calif. — A man convicted of twice ejaculating into a co-worker’s drinking water has lost his appeal.

A panel of Orange County judges upheld the conviction of 32-year-old Michael Kevin Lallana. Lallana was convicted in February of two misdemeanor counts of battery.

In April, he was sentenced to six months in jail and three years’ probation.

He was also required to register as a sex offender and ordered to pay $27,411 in restitution to cover the victim’s lost income and therapy costs, prosecutors said.
