YORK, Neb. — A man currently serving time for the attempted assault of an officer is seeking $5 million for being injured during that same assault.
The York News Times reports that Max McCall, 27, was pursued by a sheriff’s deputy dispatched to a rural York County home after it was reported that McCall was threatening to kill someone. During pursuit, McCall lost control of his vehicle.
McCall then got out of his vehicle with a rifle and aimed it at the deputy. He was told to put the weapon down, but instead opened fire on the deputy. He missed, and the deputy returned fire, hitting McCall.
McCall then crawled under his vehicle and attempted to turn his rifle on himself, but the deputy wrestled the gun away from him. The gun discharged again.
McCall was taken to a Lincoln hospital for treatment and then transported to the York County Jail, where he claims he did not receive proper medical treatment.
The York County Commissioners unanimously denied his $5 million tort claim for damages.
