Ruling expected on fairness of agreement to integrate HIV-positive inmates in Ala. prisons

The settlement calls for the HIV-positive male inmates to be integrated by November 2014

MONTGOMERY, Alabama — An American Civil Liberties Union lawyer said she expects a federal judge to rule Monday on the fairness of an agreement to integrate HIV-positive inmates with the general prison population in Alabama.

U.S. District Judge Myron Thompson held a hearing today at Limestone Correctional Facility, where HIV-positive male inmates have been housed for years. The hearing was closed to the media. It was held at the prison to allow inmates to testify.

ACLU attorney Margaret Winter, lead counsel for the HIV-positive inmates who sued in 2011, said 10 of those inmates testified today and expressed some concerns about the settlement.

The settlement calls for the HIV-positive male inmates to be integrated by November 2014. The Department of Corrections has already moved eight HIV-positive inmates at Julia Tutwiler Prison for Women into the general population.There are about 240 HIV-positive male prisoners.
