Judge considers trial delay in CO’s death

Judge will hear arguments over whether to delay death penalty trial after new evidence cast doubt on original conviction

CASTLE ROCK, Colo. — A suburban Denver judge will hear arguments over whether to delay the death penalty trial of an inmate accused of killing a corrections officer after new evidence cast doubt on his original conviction.

Prosecutors are asking to postpone the trial for at least a month on Thursday so they can respond to questions about whether Edward Montour actually killed his 11-week old daughter. On Tuesday, a coroner changed Taylor Montour’s manner of death from homicide to unknown.

Montour was serving a life sentence for her 1997 death when prosecutors say he killed corrections officer Eric Autobee.

His attorneys want the death penalty dropped because they say he was wrongly convicted.
