Iowa prison inmates sue over release dates

Offenders say they were held past their release dates and deserve compensation

DES MOINES, Iowa — Several Iowa prison inmates have filed a class-action lawsuit against the state Department of Corrections, saying they were held past their release dates and deserve compensation.

The inmates contend that “hundreds, if not thousands, of Iowa inmates” were confined in state prison facilities for too long in violation of their constitutional rights.

The lawsuit was filed this past week in Polk County District Court on behalf of Richard Scott and other inmates who believe they were held beyond their release dates. The filing said Scott, a convicted sex offender from Mahaska County, was held an extra 46 days, citing a decision issued over the summer by the Iowa Supreme Court that outlined new rules for calculating release dates.

That ruling, in the case of convicted sex offender Michael Anderson, said Anderson deserved credit for time spent under home supervision, even though he was found to have violated probation during that time.
