DALLAS — The family of a Dallas County inmate who suffered a fatal injury while incarcerated said they plan to file a lawsuit against the sheriff’s department for negligence and failure to provide safety to inmates.
Bernardo Mario Pena died on Oct. 18 after he had apparently fought with another inmate. His family said they were not immediately notified of his injury or the incidents that led up to his death and are calling for an independent investigation.
Pena’s family and their attorney spoke with the media this morning before trying to address the Dallas County commissioners during the board’s weekly meeting. Commissioner John Wiley Price asked the family, their attorney and the president of Accion America to leave because they had not scheduled time to address the board.
