GRAND JUNCTION, Colo. — A Clifton man convicted of molesting five young children is getting his sentenced reduced from his current term of 400 years in prison.
The Colorado Court of Appeals ruled that the four-century prison sentence imposed by Mesa County District Judge Brian Flynn in the case against 67-year-old Edward Morfin cannot stand because it violates state and federal law.
Morfin was originally sentenced to 128 years to life, but the term was invalidated because of errors in tallying the total.
The Court of Appeals ruled Flynn’s re-calculation to 400 years represented an unconstitutional increase and violation of Morfin’s rights.
According to the Grand Junction Daily Sentinel, the appeals court ordered that Morfin be resentenced a third time, but not to exceed his original sentence of 128 years to life.
