SIOUX FALLS, S.D. — South Dakota inmate Eric Robert asked his attorneys not to present evidence that could spare him the death penalty, according to Keloland.com.
Robert is one of three inmates charged with killing corrections officer Ron Johnson in April.
Friday’s hearing covered some of the rules and guidelines that will be followed during his sentencing hearing, which starts on October 24th. At the end of the trial, the judge will decide if Robert will get life in prison, or the death penalty.
Robert’s attorney Mark Kadi said his client doesn’t “necessarily want to present evidence that would prevent him from getting a death sentence.”
