DOVER, Delaware — Law enforcement officials may subpoena prison phone recordings if the calls can aid in investigating or preventing a crime, the Delaware Supreme Court has ruled.
In so holding, the high court affirmed appellant Izzy Whitehurst’s witness-tampering conviction.
“An ongoing investigation in one crime and the investigation of a potential subsequent crime, witness tampering, fall within the important government interest of investigating and preventing criminal activity,” Justice Randy J. Holland said. “Even if the tip comes from an uncorroborated source, the state has an interest in investigating criminal activity.”
