Vt. man charged in assault of CO

BRATTLEBORO, Vt. Herbert E. Fagans III, 30, of Brattleboro, was arrested for simple assault on a correctional officer and disorderly conduct, according to Vermont State Police.

Fagans, an inmate, was yelling obscenities at the nursing staff inside the Marble Valley Regional Correctional Center in Rutland when corrections officers Greg Dwyer and Conrad Looney intervened, according to a police news release.

Also according to the release: Fagans failed to comply with the officers’ requests, and took a hostile stance, faking a charge at Officer Looney. Fagans continued to disobey the officers and was sprayed with pepper spray. After he was sprayed, Fagans rushed at the two officers swinging his arms and striking Officer Looney in the face, grabbing his neck and scratching his arm. Fagans was subsequently subdued.

Looney received minor injuries from the assault, police said. Fagans was screened by medical staff and placed in a high security area of the correctional center. He is charged with assaulting a correctional staff and disorderly conduct.

Fagans is due in Rutland Criminal Court court Oct. 3.
