PIERRE, S.D. — A motion to delay Rodney Berget’s execution has been filed by his lawyer.

The Argus Leader reports that Berget is scheduled to be executed the week of May 3. The delay would provide time for his application for appeal to be reviewed.

Berget and Eric Robert killed CO Ronald Johnson during an escape attempt in 2011; Robert put on Johnson’s uniform to escort a large box with Berget inside toward the prison gate.

They were caught before making it out of the prison.

Robert was executed in 2012.

A third inmate was sentenced to life in prison for providing the plastic wrap and pipe used to kill Johnson.
