SEATTLE -- A prison inmate accused of strangling Corrections Officer Jayme Biendl at the Monroe Correctional Complex in January was charged Friday with aggravated murder in Snohomish County Superior Court.
Prosecutors have not yet decided whether to seek the death penalty against Byron Scherf.
Scherf was charged with aggravated murder last month in Everett District Court, but Snohomish County prosecutors dismissed the charge and refiled it in Superior Court to prosecute him in the Jan. 29 slaying of Biendl.
Scherf is scheduled to be arraigned on Wednesday. Snohomish County Prosecutor Mark Roe has 30 days from the arraignment to decide whether to seek the death penalty, although he had said he may not take that long to make a decision.
