CONCORD, Pa. — A former Delaware County corrections officer pleaded guilty Monday to one count of conspiracy to possession of a controlled substance with the intent to distribute for smuggling drugs into the county jail in Concord.
Brian Peacock , 38, Darby, was sentenced to time served to 23 months with three years of consecutive probation by Common Pleas Court Judge Dominic Pileggi under negotiated terms worked out by Assistant District Attorney Beth Ramos and defense counsel Baltazar Rubio.
Peacock was arrested Nov. 3 following an investigation by Delaware County Criminal Investigation Division Detective Michele Deery and charged with solicitation to possess a controlled substance with the intent to deliver, possession with the intent to deliver, criminal use of a communication facility, and criminal attempt to bring contraband and controlled substances into the prison.
Peacock previously entered into a negotiated waiver of his preliminary hearing where all but the conspiracy charge were withdrawn. That waiver was contingent upon a non-trial disposition.
According to an affidavit of probable cause:
Deery and a Delaware County prison investigator met with an inmate on Oct. 6 who told them Peacock was bringing narcotics into the prison and distributing them to various inmates.
They pointed to a conversation they had with Peacock in which he asked if they were “ready,” meaning ready to receive contraband he would smuggle into the jail.
A surveillance video showed Peacock having a conversation with the inmate in the same location and time as the inmate had described. It was not a location Peacock had been assigned to that day.
Investigators provided the inmate a phone number to an undercover officer.
The inmate told Deery on Oct. 30 that he had passed that number on to Peacock. The inmate said Peacock told the inmate the fee was $2,000 and that they agreed the package would contain approximately 170 strips of suboxone and three packs of cigarettes.
Peacock began contacting the undercover officer Oct. 31.
That officer met with Peacock at about 3:30 p.m. on Nov. 3 at a predetermined location in Glen Mills, near the county jail. Peacock got into the undercover officer’s vehicle, and took the $2,000 and a package containing what he believed was the agreed-to contraband.
When Peacock asked what was in the package, the undercover officer said it was the cigarettes and the suboxone, and told Peacock to make sure the items made it to the inmate. Peacock replied that he would smuggle the items in that day or the next, noting the block was “hot.”
Peacock then drove to the jail, entering the parking lot at 3:46 p.m. He was stopped when he entered the facility for his shift. A search of his vehicle recovered the $2,000.
After being read his Miranda rights, Peacock admitted to meeting the undercover officer, but said he destroyed the drugs because he thought the man he met was a cop.
Peacock was taken into custody and given 10 percent of $100,000 bail, which he could not post. Bail was reduced to $250,000 unsecured Nov. 18 and Peacock was released that same day, according to online court records.
Peacock was given credit for those 15 days served under the plea. He must also forfeit $1,000, pay a $1,000 fine, comply with any recommendations of substance abuse and mental health evaluations, provide a DNA sample to state police and perform 40 hours of community service.
Peacock did not exercise his right to speak before the court Monday.
