DAYTONA BEACH — The capital murder trial of an inmate accused of killing a state corrections officer has been moved to March.
Enoch Hall faces the death penalty if convicted of first-degree murder in the death of Donna Fitzgerald at Tomoka Correctional Institution in Daytona Beach.
Hall, who is serving a life sentence for a 1993 rape and kidnapping, is accused of killing the 50-year-old officer June 25 at a prison work facility.
On Tuesday, Hall’s attorney argued several points challenging the constitutionality of the state death-penalty law.
Assistant Public Defender Matt Phillips also asked the judge to order prosecutors to release a list of the factors they’ll use to argue for the death penalty.
However, Chief Circuit Judge J. David Walsh denied the requests, which have become standard for death-penalty cases.
