Sentence suspended for NM woman who battered detention officers

She kicked and scratched detention officers after officers attempted to search her jail cell for contraband mascara

ALAMOGORDO, N.M. — A 20-year-old Kirkland woman was sentenced Monday to 10 years in prison for her part in the burglary of an elderly couple’s home on Nov. 16, 2009.

Felicia Peters was sentenced to nine years for second-degree felony burglary and one year for two counts of petty misdemeanor larceny of $250 or less.

Peters was also sentenced on her third-degree felony robbery, attempt to commit a felony, conspiracy aggravated burglary, fourth-degree felony theft of a credit card and automobile burglary, but the 12th Judicial District Attorney’s office is filing a motion for an adjudicatory hearing to clarify District Judge Bill Brogan’s sentence in the case.

Peters was also sentenced to three years for fourth-degree felony battery upon a peace officer in a separate incident that happened on June 18, 2010, while she was being detained at the Otero County Detention Center on her Nov. 16, 2009, charges.

She kicked and scratched detention officers after officers attempted to search her jail cell for contraband mascara that Peters was not allowed to have in her cell.

Senior Trial Prosecutor Wayne A. Jordon, who represented the state, said Peters will be placed on five years probation and two years parole to run consecutively.

“I am not satisfied with the sentence,” Jordon said. “I really wanted a 19-year sentence on Peters. I am going to file a judgment and sentencing on her battery upon a peace officer. I am going to ask the court to clarify the sentence in a judicial inquiry.”

Peters and her accomplice, William Beaty, robbed a White Sands Community elderly couple of money and personal items around 12:30 a.m. Nov. 16, 2009.

The elderly man was battered by Beaty during the robbery.

Alamogordo Department of Public Safety detectives investigating the robbery learned the suspects allegedly planned to rob other residents within the White Sands Community, which is in the 600 block of South White Sands Boulevard.

A Crime Stoppers tip provided detectives with information as to the possible identity of one of the suspects.

ADPS officers and detectives located Peters attempting to board a Greyhound bus to Farmington in the company of Beaty around 5:45 p.m. Nov. 20, 2009.

Beaty was sentenced to four years in prison followed by two years of parole for his part in the crime.

During Peters’ sentencing, Jordon said that she has an extensive juvenile record.

“I think she’s a psychopath,” he said. “She shows no remorse for her actions. She knocked on the door and gave a plea that she needed help. Peters was threatening the elderly woman.”
