SCOTTSBLUFF, Neb. — A Nebraska woman has been charged with stealing the tax refund of her deceased sister, fallen corrections officer Amanda Baker who was killed back in February.

The Star Herald reports that Cassandra Baker was charged with felony theft after the taking and unauthorized use of a financial transaction device.

Baker first appeared in Scottsbluff County Court on Sept. 26, and her case has been bound over to Scottsbluff County District Court where she is scheduled to be arraigned on Nov. 14.

According to the mother of both women, Amanda Baker had filed her federal and state tax returns for the tax year 2013 prior to her death. On Feb. 20, the federal tax refund had been deposited the amount of $4,263 onto a prepaid credit card used by a tax filing company.

The filing in the probate case alleged that Cassandra Baker had spent the tax funds for her personal use.

Baker’s attorney, Todd Morten, has filed a plea and abatement motion in the case, arguing that there is insufficient evidence to support charges against Baker.
