CINCINNATI, Ohio — The man accused of shooting his daughter to death on Sunday wants out of jail so he can attend her funeral.

Hugh McCloskey Jr., the attorney for Deandre Kelley, filed a Wednesday motion asking that Kelley be allowed to attend the Saturday funeral of Shanti Lanza, his 11-year-old daughter. A noon hearing Thursday will be held before Hamilton County Municipal Court Judge Melissa Powers who will make the decision.

Kelley, 34, is in the Hamilton County Justice Center on a $500,000 bond, charged with reckless homicide that can send him to prison for up to three years.

McCloskey said the girl’s death appears to be an accident. Before the shooting, Kelley had argued with the girl’s mother who was trying to keep him out of her Sedamsville house because she suspected he was drunk. Kelley is accused of responding by firing shots in the air, one of them killing his daughter.
