BURLINGTON, Vt. — The alleged victim of a correctional officer’s sexual assault has decided to remove herself from participation in a third trial, which has resulted in charges being dropped against the former correctional officer.
The Burlington Free Press reports that Richard Gallow had pleaded not guilty to lewd and lascivious conduct and sexual assault without consent. The case against him has ended in mistrial twice when juries could not reach a verdict.
Prosecutors alleged that sexual misconduct by the former officer happened in a prison cell when the victim was incarcerated at the Chittenden Regional Correctional Facility for a few days in October 2010.
The victim did not report the abuse until she was back in the facility the following year, when she expressed being near Gallow.
Gallow was fired from his position in 2013 on grounds of misconduct while his case was pending in Vermont Superior Court.
The second attempt to try Gallow’s case ended up in a mistrial when a jury member read a newspaper while sitting on jury.
