FREMONT COUNTY, Colo. — A former corrections officer was sentenced to a deferred judgment and 12 months of probation for assault in the second degree, a Class 6 felony – heat of passion, after he placed a co-worker in a chokehold in April.
Seth L. Davis, 20, also must complete 48 hours of community service and an anger management course, and write a letter of apology to the victim. There is a stipulation to no jail as a condition of probation, and the protection order will remain in place.
All parties felt the agreement was appropriate given Davis’s age and lack of criminal history.
According to an affidavit, Davis entered the control center at Centennial Correctional Facility and confronted a fellow corrections officer about speaking with a female coworker. He reportedly told the co-worker to stay away from the woman and placed him in a chokehold.
The victim reported his airway was restricted to the point he thought he was going to lose consciousness. The two reportedly tumbled to the ground, and Davis allegedly let go of the chokehold after the victim grabbed a can of oleoresin capsicum spray from a nearby wall.
Davis told investigators that the maneuver was “horseplay” and both officers were laughing before the fall and then joking afterward.
The victim did not participate in Monday’s plea and sentencing hearing.
