Sentence confusion clouds Marion County Jail inmate’s release

Two courts gave two different sentences

INDIANAPOLIS — A case of court sentence confusion may help explain how a Marion County Jail inmate ended up back behind bars this week for the same conviction he had just been released on a few hours earlier.

Jail records show Christopher Phelps, 53, was booked into the Jail on Friday, after pleading guilty to an Operating While Intoxicated charge stemming from an arrest in July 2013.

Court filings obtained by I-Team 8 show a judge ordered Phelps to be held in jail for one week, including good behavior time.

“Defendant to be held in the Marion County Jail until 10/03/2014, then released to self-report to Marion County Community Corrections,” reads an order signed by Judge David Cook. Criminal court staff told I-Team 8 Tuesday that order was filed at the September 26 sentencing.

But, another court sentencing entry also filed that same day orders Phelps to be held for six days – reduced to three days with good behavior credit time.
